1. Introduction and Agreement

1.1 About These Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and House And Land Packages Pty Ltd (ABN 92 631 641 408) ("HALP"). By accessing or using any of our websites, platforms, or services, you agree to be bound by these Terms.

For Advertisers (including agents, builders, and developers), these Terms also include the Listing Agreement, which is incorporated by reference. In the event of any inconsistency between these Terms and the Listing Agreement regarding listing specifics, the Listing Agreement shall prevail.

1.3 Acceptance of Terms

1.4 Changes to Terms

We reserve the right to modify these Terms at any time. Changes take effect immediately upon posting (or as otherwise specified). Your continued use constitutes acceptance.

2.2 Nature of Service

HALP is an information and advertising platform. We facilitate connections between property seekers and providers. We are not a real estate agent, developer, builder or financial advisor. Property listing inquiries go directly to the listing agent, developer, or builder — HALP does not store, process, or access those inquiries.

2.3 Service Availability

Services are provided "as is" and "as available". We may modify, suspend, or discontinue services at any time. Our services are delivered through AWS (hosting/backups), Synergywholesale (domain), Google Workspace, Stripe (payments), Pipedrive and ActiveCampaign (CRM), and Zapier (automation).

3. User Accounts and Registration

You must provide accurate information, be at least 18, and keep your credentials secure. We may suspend or terminate accounts that breach these Terms.

4. User Conduct and Prohibited Activities

Prohibited activities include misuse of the platform (bots, scraping, unauthorized access), harmful content (spam, malware, fraud), illegal activities, harassment, and commercial misuse. Violations may result in suspension, removal of listings, legal action, or reporting to authorities.

5. Property Listings and Information

Property listings and information are provided and owned by third parties (developers, builders, agents, data providers). HALP does not verify all listing information and does not endorse any provider. Always verify critical information (including school zone data) directly with the property provider and the relevant education department.

6. Business Directory Listings

Business listings require a valid ABN or ACN, accurate information and compliance with Australian Consumer Law. Premium subscriptions auto-renew unless cancelled. Listings may be removed for breach of these Terms, non-payment or credible complaints.

7. Payment Terms (Advertiser Subscriptions)

Fees are as displayed on our website or in the applicable Listing Agreement, subject to change with 30 days notice. All fees are in AUD, exclusive of GST unless stated. Payments are processed via Stripe (PCI-DSS Level 1). Subscriptions auto-renew unless cancelled. No refunds for voluntary cancellations; pro-rata refunds for technical issues preventing service access, processed within 14 business days.

8. Intellectual Property Rights

All content and materials on our platforms are owned by HALP or licensed to us, including the "HALP", "House And Land Packages" and "Boutique Developments" marks. Users receive a limited, non-exclusive, non-transferable, revocable licence for personal, non-commercial use. If you believe content infringes your copyright, contact legal@halp.com.au.

9. Disclaimers and Limitations

HALP does not provide financial, mortgage, investment, legal, tax or real-estate advice. Calculators are estimates only. Information may contain errors or be outdated. We do not guarantee continuous, uninterrupted access.

10. Limitation of Liability

To the maximum extent permitted by law, HALP is not liable for direct or indirect damages arising from your use of our services. Where liability cannot be excluded, our total liability is limited to $100 AUD for free services, or for paid services the lesser of $1,000 AUD or the amount you paid in the prior 12 months. Nothing excludes consumer guarantees under the Australian Consumer Law. You indemnify HALP against claims arising from your breach of these Terms or misuse of the services.

11. Dispute Resolution

Contact legal@halp.com.au and allow 30 days for informal resolution before initiating proceedings. These Terms are governed by the laws of New South Wales, Australia, with exclusive jurisdiction in NSW courts. Optional arbitration in Sydney under ADRA rules is available. Class actions are waived to the extent permitted by law.

17.2 Property Listing Inquiry Flow

Property listing inquiries route directly to the listing agent/developer. HALP does not store, read, or process the inquiry. This applies to property listing inquiry forms only — Contact Us, Join Us and Advertise With Us forms are handled by HALP as described in 17.3.

17.3 Platform Inquiry Forms

When you use our platform forms (Contact Us, Join Us, Advertise With Us) we collect and store your information in our CRM systems (Pipedrive, ActiveCampaign) and Google Drive. Our Privacy Policy governs this data.

17.4 User Acknowledgment

By using any inquiry form on our platform, you acknowledge and agree to the flows above.

17.5 Advertiser Obligations

Listing agents and advertisers agree to handle inquiries in accordance with applicable privacy laws, maintain their own privacy policy, and comply with Australian Consumer Law.

12. General Provisions

13. Special Terms for Specific Services

Mortgage calculator results are estimates only and not pre-approvals. School zone data is aggregated from public government databases; always verify with the education department and specific school. Property alerts are sent based on your saved search criteria. Mortgage referrals may involve a referral fee or commission.

Content: All information, text, images, data, software and materials on our platforms. Property Provider: Developers, builders, real estate agents and other entities listing properties. Advertiser: Professionals and businesses advertising in our directory. Personal Information: as defined in the Privacy Act 1988. Listing: Any property advertisement, business directory entry, or content posted on our platforms.
